1. Scope and Host
- This document applies to confirmed bookings of Gniazdo Orlika apartment no. 101 at 6 Strażacka Street, 58-540 Karpacz.
- The Host is “Polimet” Krzysztof Policht, Przedwojów 90, 58-400 Przedwojów, Polish tax ID 6141446675, REGON 231078865; rezerwacje@gniazdoorlika.pl; +48 661 110 895.
- An unpaid date hold is not a confirmed booking and expires automatically, so it does not need to be cancelled.
2. How to cancel
- Send an unambiguous cancellation message to rezerwacje@gniazdoorlika.pl. For security, give the booking person’s name, stay dates and booking identifier if assigned.
- Cancellation takes effect when the message reaches the Host’s mailbox in a form that can be read. Acceptance will be confirmed by email.
- Periods are calculated in the Europe/Warsaw time zone backwards from 3:00 pm on the scheduled arrival date. A “full day” below means 24 hours.
3. Guest cancellation charges
- If the cancellation message arrives at least 14 full days before 3:00 pm on arrival day, cancellation is free and 100% of the paid price is refunded.
- If it arrives at least 7 but fewer than 14 full days before 3:00 pm on arrival day, the charge is 50% of the total booking price and the remaining 50% is refunded.
- If it arrives fewer than 7 full days before 3:00 pm on arrival day, the charge is 100% and no refund is due.
- A no-show without prior cancellation is charged at 100% of the total booking price.
- Voluntarily shortening a stay after it begins does not reduce the price or produce a refund for unused nights unless expressly agreed or caused by a matter for which the Host is responsible.
4. Refunds
- A refund due will be initiated without undue delay and no later than 14 days after effective cancellation.
- It is made by the original payment method unless the Guest expressly agrees to another method that creates no additional cost. Posting time also depends on the bank or payment provider.
- The Host currently takes no security deposit, so cancellation involves no deposit deduction.
- Where an invoice was issued, a refund or price change is recorded in a correcting document as required by law.
5. Changing dates
- A change is not automatic and requires the Host’s express confirmation on a durable medium. The original dates remain binding until then.
- Moving the booking depends on availability and the price for the new dates. Any difference is paid or refunded as agreed.
- If no change is agreed, the Guest may cancel under section 3 calculated from the original dates.
6. Cancellation by the Host and extraordinary events
- If the Host cannot perform a confirmed booking, the Guest is informed without delay and 100% of the price received is refunded. This does not limit further rights under mandatory law.
- For a documented extraordinary event, the parties may individually agree a date change or more favourable cancellation terms. This requires the Host’s express confirmation and does not automatically alter section 3.
7. No statutory withdrawal right
The contract concerns accommodation on a specific date or during a specific period. Under Article 38(1)(12) of the Polish Consumer Rights Act, the consumer has no statutory 14-day right to withdraw from this distance contract. This Policy is a separate contractual right and does not limit remedies for the Host’s non-performance or defective performance.
