Booking and house rules — translation of version 2026-09-25-v5
This is a faithful English translation of the published Polish document. It is provided so that an English-speaking Guest can understand the booking contract before payment. Mandatory consumer rights remain unaffected.
1. The Host and the Apartment
- The Host, service provider and party to the accommodation contract is “Polimet” Krzysztof Policht, Przedwojów 90, 58-400 Przedwojów, Polish tax ID (NIP) 6141446675, REGON 231078865, hereinafter the “Host”.
- Booking, stay and complaint contact: rezerwacje@gniazdoorlika.pl, +48 661 110 895. Postal correspondence may be sent to the address above.
- These Rules apply to bookings and stays in apartment no. 101, Gniazdo Orlika, in the Orlik Residence building at 6 Strażacka Street, 58-540 Karpacz, hereinafter the “Apartment”.
- The Apartment has a floor area of 40.25 m² excluding the balcony and accommodates no more than four people. The contract is for tourist or short-term accommodation and is not intended to meet permanent housing needs.
- A “Guest” is the person making the booking and, where appropriate, each person included in the stay. The person making the booking must be an adult and is responsible for informing the other Guests of these Rules.
2. Website and technical requirements
- gniazdoorlika.pl allows users to check availability and price free of charge, submit a booking form, proceed to payment, receive booking messages and complete pre-check-in.
- Use requires an internet-connected device, a current browser supporting HTTPS and JavaScript, an active email address and a telephone number. Data-transfer costs depend on the Guest’s contract with their provider.
- A Guest must not submit unlawful content, attempt to breach security or use the website in a way that interferes with its operation.
- Website errors may be reported to rezerwacje@gniazdoorlika.pl. Where possible, the report should include a problem description, date, device or browser used and a screenshot containing no payment data.
3. Entering into and confirming a booking
- The Guest selects available dates and the number of people, reviews the total price, provides truthful details, accepts the required documents and selects a button clearly indicating the obligation to pay.
- Once the form has been submitted correctly, the system provisionally holds the dates for the time displayed on the payment screen. The standard hold period is 35 minutes.
- Submitting the form, creating a hold or returning from the payment screen does not confirm a booking. The booking is concluded and confirmed only after the full price has been received, the system has received a verified confirmation from the payment provider and the Guest has been sent confirmation on a durable medium, in particular by email.
- Failure to pay in full during the hold period, a payment error or abandoned payment causes the hold to expire and the dates to become available again. A payment recorded after expiry requires manual investigation and does not automatically take dates away from another booking.
- Availability is checked again immediately before payment is created. Once external channels are enabled, the calendar will be synchronised by a channel manager. If a technical discrepancy occurs, the Host will contact the Guest without delay; two stays must not be confirmed for the same Apartment and dates.
- The booking confirmation contains at least the booking identifier, dates, number of people, price and accepted document versions.
4. Price, payment and sales document
- The price is for the entire Apartment for up to four people. There is no surcharge for the third or fourth person.
- Before any obligation to pay arises, the website displays nightly rates, any cleaning fee, discounts and the binding total price. The Guest will not be charged costs that were not clearly stated beforehand.
- A direct booking requires payment of the full price. The Host accepts cashless payments only: through the provider shown on the secure payment page or, where individually agreed, by bank transfer to the Host’s account. Cash is not accepted. The online methods actually available, such as card, BLIK or Przelewy24, depend on provider configuration and are displayed before payment.
- The Host does not currently collect a security deposit. This does not exclude liability for actual, documented damage.
- The price shown to the Guest includes the local tourist tax and no separate payment by the Guest is required. The Host covers and accounts for it within the stay price, applying the rate for the stay dates, number of people and days, and statutory exemptions. For stays covered by the 2026 rate, it is PLN 3.46 per person for each commenced day.
- Short-term accommodation is subject to VAT at the 8% rate. The Host issues a VAT invoice at the Guest’s request made when booking (the “I need an invoice” box) or within 3 months of the end of the month in which the service was supplied or payment was received, using the link sent in the booking confirmation or by writing to rezerwacje@gniazdoorlika.pl. A Guest booking as a business (with a Polish NIP or a VAT number) always receives an invoice. The Guest provides the buyer details together with the invoice request.
- If an invoice is issued and the full price is received before the service is supplied, the Host issues an advance invoice for the amount received. If it covers 100% of the price, no separate final invoice is issued unless required by law or a correction is needed. In other cases the invoice appropriate to the tax point is issued.
- Invoices are submitted to Poland’s National e-Invoice System (KSeF) in accordance with the Host’s practice and applicable law. A Guest copy is sent to the provided email address in an accessible form. Where an invoice was issued, a refund or price change may require a correcting invoice.
5. Cancellation and change of dates
- Cancellation and refund conditions are set out in the “Cancellation policy” accepted together with these Rules before payment.
- The service concerns accommodation on a specific date or during a specific period. Under Article 38(1)(12) of the Polish Consumer Rights Act, the statutory 14-day right to withdraw from a distance contract does not apply to this accommodation contract. A separate document sets out a contractual cancellation right on more favourable terms.
- A change of dates requires the Host’s express confirmation and depends on availability and the price for the new dates. The original dates remain binding until the change is confirmed.
6. Arrival, pre-check-in and access
- Check-in is from 3:00 pm on arrival day and check-out is by 11:00 am on departure day unless the parties agree otherwise on a durable medium.
- Before arrival, the Guest completes the register of people included in the booking to the extent necessary to operate the stay and account for the local tourist tax. The data must be truthful and match the people actually staying overnight.
- Once full payment has been confirmed, a temporary entry code may be supplied before arrival. It has a future validity period, works only during the period stated in the instructions and must not be given to anyone outside the booking. The same code may be sent again by email and SMS at 12:00 noon on the arrival day. The requirement to complete the guest register before arrival remains separate from the time at which the code is supplied.
- If the access device fails to create a code or is unavailable, the Host will use a manual emergency procedure and, after verifying the Guest, provide an alternative means of entry.
- The Guest should immediately report an inability to enter, a failure or a material discrepancy between the Apartment and the offer so the problem can be addressed promptly.
7. House rules
- No more than four Guests included in the booking may stay overnight. The Apartment must not be sublet or made available to anyone outside the booking.
- Smoking tobacco or electronic cigarettes and using an open flame are prohibited in the Apartment and wherever prohibited by law or building rules.
- Quiet hours are 10:00 pm to 7:00 am. Parties and behaviour disturbing residents or other Guests are prohibited.
- Pets are not accepted in the Apartment.
- The Guest may use private outdoor parking space no. 101 and common areas for their intended purpose and in accordance with instructions and safety rules.
- When leaving, the Guest closes windows, switches off unnecessary appliances, closes the door and follows the lock instructions. The entry code or access medium must not be passed to third parties.
- In an immediate threat to health, life or property, first call the emergency services on 112 and then contact the Host.
8. Damage, failures and items left behind
- The Guest should immediately report any failure, damage or loss noticed.
- Under applicable law, the Guest is responsible for damage caused by themselves or other Guests in the booking. Any claim must state its basis and scope and document the damage; the system does not impose automatic penalties or deductions.
- The Host is responsible for proper performance under applicable law. These Rules do not exclude or limit consumer rights or liability that cannot be excluded by contract.
- Found items are secured to a reasonable extent. The parties agree the method and cost of return individually, subject to applicable law.
9. Complaints and consumer disputes
- Complaints may be submitted by email to rezerwacje@gniazdoorlika.pl or by post to the Host’s address in section 1.1.
- Where possible, the complaint should identify the booking, describe the problem, state when it occurred and the expected solution. Missing information does not deprive a consumer of statutory rights.
- The Host responds to a consumer complaint within 14 days of receipt unless mandatory law provides another period.
- If a complaint is unresolved, the Host will state on a durable medium whether they agree to participate in out-of-court consumer dispute resolution and, if so, identify the appropriate authorised body. The absence of a prior commitment does not limit the consumer’s right to seek assistance from a consumer ombudsman or another authorised institution.
10. Personal data and final provisions
- Data processing is described in the Privacy policy.
- Polish law applies. This choice does not deprive a consumer of protection granted by mandatory provisions that cannot be excluded by agreement.
- The invalidity of one provision does not affect the others; the appropriate legal provision applies in its place.
- These Rules apply to bookings made from the effective date stated with the published version. A change will not worsen the terms of an earlier confirmed booking without the parties’ express agreement.
